1. Acceptance of Terms

Welcome to HIITS Golf. These Terms of Service ("Terms") govern your access to and use of the HIITS Golf website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Services.

2. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.

3. Access to Services

We reserve the right to withdraw or amend our Services, and any service or material we provide via the Services, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Services are unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Services, or the entire Services, to users.

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Services.

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of HIITS Sports, LLC and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of HIITS Sports, LLC.

6. User Generated Content

By posting, uploading, inputting, providing, or submitting content to the Services, you grant HIITS Sports, LLC and our affiliated companies and necessary sublicensees a non-exclusive, worldwide, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, distribute, and display such content in connection with the Services and HIITS Sports, LLC's (and its successors' and affiliates') business.

7. Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate HIITS Sports, LLC, a HIITS Sports, LLC employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm HIITS Sports, LLC or users of the Services or expose them to liability.

8. Sweepstakes and Promotions

Any sweepstakes, contests, or other promotions (collectively, "Promotions") made available through the Services may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

All sweepstakes are conducted as "No Purchase Necessary" promotions, and making a purchase will not increase your chances of winning. Void where prohibited by law. All sweepstakes are subject to the official rules made available at the time of the promotion.

For certain promotions involving physical products, please note that there may be a 90-day period before golf clubs or other equipment will be shipped to winners or qualifying participants. By participating in such promotions, you acknowledge and agree to this waiting period.

9. Product Information and Pre-Orders

We strive to provide accurate product information on our Services. However, we do not warrant that product descriptions or other content on the Services are accurate, complete, reliable, current, or error-free.

For pre-order products, the estimated shipping date is provided as a general guideline and may be subject to change. By placing a pre-order, you acknowledge that the product is not yet available for immediate shipment and that the estimated shipping date is not guaranteed. We reserve the right to adjust the estimated shipping date based on production timelines and other factors beyond our control.

Our expected delivery time for pre-orders is 90 days or less from the date of purchase. However, due to uncertainties in global trade markets and supply chains, there is a possibility, though unlikely, of delays beyond this timeframe. In the rare event that delivery exceeds our 90-day window, pre-order customers who no longer wish to wait for delivery may opt to forfeit their HiiTS Driver and receive a full refund of their purchase price.

At the point of order, we will provide you with an estimated shipping date. If we are unable to provide shipping by the estimated date for any reason, you may request and will be granted a full refund if you choose not to wait for shipping. Our goal is to ensure complete customer satisfaction with every purchase.

10. Purchases and Payment

You agree to provide current, complete, and accurate purchase and account information for all purchases made through the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address.

11. Shipping and Returns

Shipping times and methods may vary. We are not responsible for delays due to customs, postal/carrier issues, or events outside of our control. For international shipments, import duties, customs fees, and taxes may be applied by your country's customs authorities upon arrival. These charges are beyond our control, are the responsibility of the recipient, and are not included in the product or shipping price. For returns, please contact our customer service team at support@hiitsgolf.com. All returns must be initiated within 30 days of receiving your product. Products returned unused and in original packaging with wrapping intact and no blemishes (such as unwanted gifts) are eligible for a full refund minus shipping costs once received by HiiTS Golf. Products that have been unwrapped, used, or show any damage caused by the customer are not eligible for return. For warranty claims on HiiTS drivers or training aids where the product has failed under normal use conditions, our manufacturing team will assess whether the failure was due to a manufacturing defect or misuse; products deemed defective will receive a replacement. Our goal is to ensure your complete satisfaction with every purchase.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. HIITS SPORTS, LLC AND ITS SUPPLIERS AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. NEITHER HIITS SPORTS, LLC NOR ITS SUPPLIERS AND LICENSORS MAKES ANY WARRANTY THAT THE SERVICES WILL BE ERROR FREE OR THAT ACCESS THERETO WILL BE CONTINUOUS OR UNINTERRUPTED.

13. Assumption of Risk & Physical Activity Disclaimer

USE AT YOUR OWN RISK. By purchasing, using, or participating in any HiiTS Golf products, training programs, protocols, or services (including but not limited to the HiiTS Speed Training Driver, online training platform, and any associated training content), you acknowledge and agree to the following:

Physical Activity Risks: Golf training, speed training, and any physical exercise carry inherent risks of injury, including but not limited to muscle strains, joint injuries, back injuries, nerve damage, and other physical harm. You understand that using the HiiTS Driver and following any training protocols involves physical exertion and movement that may result in injury.

Assumption of Risk: You voluntarily assume all risks associated with using HiiTS products and training programs, whether known or unknown, including risks arising from the negligence of HIITS Sports, LLC, its employees, agents, instructors, or representatives.

Medical Clearance: You represent that you are physically fit and have no medical condition that would prevent you from safely participating in golf training or physical exercise. You are solely responsible for consulting with a qualified healthcare provider before beginning any training program. HIITS Sports, LLC is not responsible for any injuries or health issues that may arise from your use of our products or training programs.

No Guarantee of Results: Individual results may vary. HIITS Sports, LLC makes no guarantees regarding speed gains, distance improvements, or any other performance outcomes. Any testimonials or results shared are individual experiences and are not guaranteed.

Proper Use: You agree to use all HiiTS products only as intended and in accordance with provided instructions. Misuse, modification, or improper use of products may result in injury and will void any warranty claims.

Release of Liability: To the fullest extent permitted by law, you release, waive, and discharge HIITS Sports, LLC, its owners, officers, directors, employees, agents, instructors, affiliates, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by you while using HiiTS products or participating in any training programs, whether caused by negligence or otherwise.

BY USING ANY HIITS GOLF PRODUCTS OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS DISCLAIMER, UNDERSTAND ITS CONTENTS, AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR PRODUCTS OR SERVICES.

14. Limitation of Liability

IN NO EVENT WILL HIITS SPORTS, LLC, OR ITS SUPPLIERS OR LICENSORS, BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR: (I) ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES; (II) THE COST OF PROCUREMENT FOR SUBSTITUTE PRODUCTS OR SERVICES; (III) FOR INTERRUPTION OF USE OR LOSS OR CORRUPTION OF DATA; OR (IV) FOR ANY AMOUNTS THAT EXCEED THE FEES PAID BY YOU TO HIITS SPORTS, LLC UNDER THIS AGREEMENT DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION. HIITS SPORTS, LLC SHALL HAVE NO LIABILITY FOR ANY FAILURE OR DELAY DUE TO MATTERS BEYOND THEIR REASONABLE CONTROL.

15. Indemnification

You agree to indemnify and hold harmless HIITS Sports, LLC, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Services, including but not limited to your violation of this Agreement.

16. Dispute Resolution

Any dispute arising from or relating to the subject matter of this Agreement shall be governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action or proceeding relating to this Agreement shall be brought exclusively in the state or federal courts located in Orange County, Florida. You hereby submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.

17. Termination

We may terminate or suspend access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Miscellaneous

These Terms constitute the entire agreement between HIITS Sports, LLC and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of HIITS Sports, LLC, or by the posting by HIITS Sports, LLC of a revised version.

If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties' original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; HIITS Sports, LLC may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.

19. HiiTS Shaft Protection Plan — Terms & Conditions

19.1 Program Description

The HiiTS Shaft Protection Plan (the "Plan") is a voluntary shaft replacement program offered by HiiTS Sports LLC ("HiiTS," "we," or "us") as an optional add-on to the purchase of the HiiTS Speed Training System. The Plan is not an insurance product, warranty, or guarantee against breakage. The Plan is a service contract that provides eligible enrolled customers with access to a replacement shaft under the terms described herein.

19.2 Enrollment & Activation

The Plan becomes active upon completion of a qualifying HiiTS Speed Training System purchase that includes a Plan tier at checkout. Coverage begins on the date of Plan purchase and continues for the selected duration (12, 24, or 60 months). Plan enrollment is personal and non-transferable. Coverage applies only to the customer associated with the original order.

19.3 Coverage Tiers & Replacement Benefit

1 Year – HiiTS Shaft Protection Plan ($24.95): Coverage for twelve (12) months from the date of purchase. Includes up to two (2) shaft replacements during the coverage period. Additional replacements beyond two (2) per 12-month period are available at $29.95 per shaft.

2 Year – HiiTS Shaft Protection Plan ($34.95): Coverage for twenty-four (24) months from the date of purchase. Includes up to two (2) shaft replacements per 12-month coverage period (up to four (4) total over the plan term). Additional replacements beyond two (2) in any 12-month period are available at $29.95 per shaft.

5 Year – HiiTS Shaft Protection Plan ($49.00): Coverage for sixty (60) months from the date of purchase. Includes up to two (2) shaft replacements per 12-month coverage period (up to ten (10) total over the plan term). Additional replacements beyond two (2) in any 12-month period are available at $29.95 per shaft.

19.4 Covered Events

The Plan covers shaft breakage that occurs during the normal, intended use of the HiiTS Speed Training System for high-speed golf swing training. A covered event requires all of the following:

  • The shaft must have broken as a direct result of training use with the HiiTS Speed Training System.
  • The customer must hold an active Plan at the time of the breakage event.
  • The customer must not have received more than two (2) replacement shafts under the current Plan within the current 12-month coverage period.
  • The claim must be submitted within thirty (30) days of the date of breakage.

19.5 Exclusions – What Is Not Covered

The Plan does not cover any of the following:

  • Clubheads, grips, ferrules, or any component of the HiiTS system other than the shaft itself
  • Intentional damage, product abuse, or misuse
  • Damage resulting from unauthorized product modification or alteration
  • Cosmetic damage, including scratches, paint wear, or other superficial issues that do not affect performance
  • Damage resulting from use inconsistent with the HiiTS Speed Training System's intended training purpose
  • Damage caused by improper storage, transport, or environmental exposure
  • Loss, theft, or unexplained disappearance
  • Claims submitted more than thirty (30) days after the date of breakage
  • Claims exceeding two (2) replacements within any 12-month period (additional replacements may be requested at $29.95 per shaft)

19.6 Replacement Shaft Specifications

Replacement shafts provided under the Plan will be HiiTS-approved components determined by HiiTS. HiiTS reserves the right to determine the appropriate replacement shaft model and specification. Replacements may be of equivalent or comparable specification at HiiTS's sole discretion. Customer requests for specific shaft models, flex preferences, or upgrades are not guaranteed and subject to availability at time of claim.

19.7 Claims Submission Process

To file a claim under the Plan, the customer must:

  • Email HiiTS customer support at claims@hiitsgolf.com within thirty (30) days of the shaft breakage event.
  • Use the subject line: "Shaft Replacement Claim — Order #[ORDER NUMBER]."
  • Provide the following information: (a) full legal name; (b) email address associated with the original order; (c) order number from the original HiiTS purchase; (d) Plan purchase date; (e) description of the circumstances of the breakage; and (f) photographic evidence of the broken shaft as requested by HiiTS.
  • Cooperate with any reasonable follow-up request from HiiTS for additional information.

HiiTS will review the claim and provide a decision within five (5) business days of receiving all required information. HiiTS reserves the right to approve or deny any claim based on the circumstances described and the terms set forth herein.

19.8 Replacement Shipping & Processing

Upon approval of a valid claim, HiiTS will arrange shipment of a replacement shaft to the shipping address provided by the customer. Shipping and handling costs for replacement shafts are the sole responsibility of the customer. HiiTS is not liable for delivery delays caused by carrier issues, incorrect addresses, weather, or other circumstances outside of HiiTS's control. Risk of loss for the replacement shaft transfers to the customer upon delivery to the carrier.

19.9 Installation Disclaimer

Replacement shafts are delivered directly to the customer. Installation of the replacement shaft is the customer's sole responsibility. HiiTS strongly recommends that installation be performed by a qualified professional club builder or golf equipment technician. HiiTS assumes no responsibility or liability for any injury to persons, or damage to equipment or property, resulting from the installation of a replacement shaft by the customer or any third party.

19.10 Assumption of Risk

By purchasing and using the HiiTS Speed Training System, the customer acknowledges and agrees that:

  • High-speed swing training is designed to develop swing velocities that may substantially exceed normal on-course swing speeds, placing additional mechanical stress on golf equipment.
  • Shaft breakage may occur as an inherent and foreseeable result of high-intensity speed training and does not constitute a product defect.
  • The customer voluntarily assumes all risks associated with the use of the HiiTS Speed Training System, including but not limited to shaft breakage and associated equipment or property damage.

19.11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HiiTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO THE USE OF THE HiiTS SPEED TRAINING SYSTEM OR THE SHAFT PROTECTION PLAN, INCLUDING BUT NOT LIMITED TO: PERSONAL INJURY, PROPERTY DAMAGE, EQUIPMENT LOSS, OR BUSINESS INTERRUPTION. HiiTS' TOTAL LIABILITY UNDER THE PLAN SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE PLAN.

19.12 Cancellation & Refund Policy

A customer may cancel the Plan within thirty (30) days of purchase for a full refund, provided no replacement claim has been submitted, approved, or fulfilled. After thirty (30) days, or following a fulfilled replacement, the Plan is non-refundable. To request cancellation, contact HiiTS customer support at support@hiitsgolf.com.

19.13 Plan Modification or Discontinuation

HiiTS reserves the right to modify, update, or discontinue the Shaft Protection Plan at any time. Customers with an active Plan at the time of any material modification will be notified via email and honored under their existing terms through the end of their coverage period, or offered a prorated refund at HiiTS's discretion.

19.14 Business Transfer or Cessation

Sale or Transfer of Business: In the event that HiiTS Sports LLC or its parent entity, HIITS Sports, LLC, is acquired by, merged with, or otherwise transferred to a successor entity, active Shaft Protection Plans will be assumed by the acquiring or successor entity as part of that transaction. The successor entity will be bound by the terms of Plans active at the time of transfer through the end of each customer's coverage period.

Business Closure or Discontinuation of Product: In the event that HiiTS Sports LLC or HIITS Sports, LLC ceases operations or permanently discontinues the HiiTS Speed Training System product line, the Shaft Protection Plan will be terminated. Upon such an event, customers with active Plans will be entitled to a prorated refund of the unused portion of their Plan, calculated from the date of closure notice through the end of their coverage period. HiiTS shall have no further obligation to fulfill replacement claims submitted after the date operations cease. HiiTS will provide written notice to active Plan holders via the email address on file as soon as reasonably practicable under the circumstances. To receive a prorated refund, customers must submit a written refund request to support@hiitsgolf.com within sixty (60) days of the date of the closure notice. Customers who do not submit a timely refund request within this period shall forfeit any entitlement to a prorated refund. This prorated refund, when properly and timely claimed, shall constitute HiiTS's sole and complete obligation to Plan holders in the event of business closure.

19.15 Governing Law & Dispute Resolution

This Plan shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising in connection with this Plan that cannot be resolved through direct negotiation shall be submitted to binding arbitration in Sumter County, Florida, under the rules of the American Arbitration Association. Each party shall bear its own costs in any such proceeding.

19.16 Entire Agreement

These Terms & Conditions constitute the entire agreement between the customer and HiiTS regarding the Shaft Protection Plan and supersede all prior communications, representations, and understandings. These Terms are incorporated by reference into HiiTS's general Terms of Service available at www.hiitsgolf.com.
